  • There are currently no West Virginia laws protecting breastfeeding. However, on January 11, 2012, West Virginia Senate Bill 4 was introduced to add § 16-1-19 to the West Virginia Code which would allow a mother to breastfeed a child in any location where the mother and child are otherwise authorized to be.
  • West Virginia employers should avoid including definite promises in the employee handbook. For example, stating that the employer will only discharge the employee for specified reasons can alter the employment-at-will relationship as the promises will be considered unilateral contracts that modify the rights of the employer to discharge without cause.
  • While West Virginia has no statutory requirements that restrict employers from asking for or using a job applicant's conviction records, the same does not hold true with arrests. Preemployment inquiries into arrest records in the Mountain State are prohibited. The rationale is that such inquiries are likely to screen out a large number of minority applicants, some of whom may have been arrested at one time based on their race.
